 Post-Accident Training Booklet  Guide to Post  Accident Drug and Alcohol Testing for Supervisors and Drivers. This compact training tool covers the mandatory requirements for post-accident testing as defined in 49 CFR Part 382 and can be used to meet the mandatory training requirements. EMPLOYER REQUIREMENTS  Employers have two
primary responsibilities with regard to post-accident testing.  Employers must conduct testing on their drivers when the post-accident testing criteria have been met and employers must train their drivers on the post-accident testing requirements. Consider the following from 49 CFR Part
382.303(f): “An employer shall provide drivers with necessary post-accident information, procedures and instructions, prior to the driver operating a
commercial motor vehicle, so that drivers will be able to comply with the requirements of this section.”
DRIVER REQUIREMENTS   Drivers also have two
primary responsibilities with regard to post-accident testing.  Drivers must remain available for testing following an accident. Additionally, drivers are required to submit to
post-accident testing as with any mandatory test. Failure to submit to post-accident testing is a violation of the prohibitions and subjects a driver to the entire return-to-duty process.
WHAT IS COVERED IN THE TRAINING BOOKLET

    Compliance Protection from civil lawsuits
    These regulations are very significant for employers. The regulations provide an employer with important protective rights if the employer complies with the requirements for conducting background investigations. The regulation states that the employer is protected in that...no action or proceeding for defamation, invasion of privacy, or interference with a contract that is based on the furnishing or use of information in accordance with the regulations may be brought against a motor carrier investigating the information (Part 391.23(l)(1)). 

    Non-compliance No protection from civil lawsuits
    However, failure to comply can subject an employer to civil lawsuits in addition to DOT fines and penalties.  For employers that are not in compliance with this requirement, FMCSA states that the protections...do not apply to persons who knowingly furnish false information, or who are not in compliance with the procedures specified for these investigations (49 CFR Part 391.23(l)(2)).
